删除举证倒置：期待迟来的纠错

举证责任倒置，曾经被认为是弱势的患者对抗强势医院技术壁垒的有力武器，受到民众和媒体的追捧。然而举证责任倒置，让医疗损害之诉讼门槛形同虚设，导致部分患者滥诉，医院或疲于应付，或低头认讹。在举证倒置的规定之下，只要能证明自己与医院有医疗关系的存在，无须任何自身损害与医疗行为有关的证明，就可以提起诉讼。结果，有人或因治疗效果未达预期，或对治疗费用不满，为达目的以诉讼来向医院施压，甚至让职业医闹找到了生存的空间。面对他们，解释劝导无效，医疗事故鉴定不做，一口咬定要赔。部分医院不胜其烦，花钱买平安之后却发现陷入恶性循环。
举证倒置还使得医护人员关注的重点发生了转变，客观上加重了患者的经济负担，也使得本已不和谐的医患关系更趋恶化。医生日益增长的“证据意识”，对饱受诟病的大包围式的检查起到了不可估量的推波助澜作用：用患者的钱，为自己的诊断上全方位的“保险”，顺带还为医院增加收入，这实在是一笔好买卖。医生和护士都专注于医疗文书的“严密”，签字项目多如牛毛，列举内容让患者心中发毛。结果，医患双方戒备森严，法律程序冠冕堂皇，人文关怀却荡然无存。
一项原本为保护患者权益而诞生的制度，却未产生应有的正面效果——医生关注病历多了，关心病人少了；医生掂量治疗的风险多了，病人接受高难手术的机会少了；医生关注证据多了，考虑费用优化少了……
世界并不是非对即错，非黑即白，在两者之间还存在着大量的灰色地带。人体千差万别，疾病千变万化，医疗行为具有太多的不确定性。每一次治疗，实际上都是一次基于经验基础上的试探，一次基于合理假设之上的冒险。加重医者的责任，未必能保护患者的权益，在医疗行为侵权中实行举证责任倒置，并非一剂良药。毫无疑问，即使举证责任真的不再倒置，医患双方已经形成的思维定势和行为方式，也不可能在短期内消除……
